If you’re an architect, attorney, property owner or tenant, real estate professional, insurance professional, contractor or subcontractor, buyer, or seller, and you need help handling construction defects, putting together an insurance claim, or navigating a construction dispute, this is for you.

Real Estate Investments Are Often the Biggest Investments in People’s Lives. That’s Why Resolving Construction Defects and Disputes — As Efficiently and Fairly As Possible — is So Important, Emotionally and Financially.

With the right expertise and guidance, you can limit extra time and money expenses — and court — and find a mutually agreeable solution.

When it comes to construction defects, if you can imagine it, someone can argue about it … which only makes sense. Defects of any kind can reduce the value of a property.

I’ve seen disputes arise about all of the following (and more):

  • Design and engineering.
  • Site selection and planning.
  • Settlement (resulting in cracks in the foundations, floors, walls, or roofs).
  • Substandard construction practices, products, and/or materials, including finishes.
  • Structural failures.
  • Poor maintenance or abuse.
  • Faulty drainage, improper landscaping and irrigation.
  • Improper plumbing, electrical and heating and ventilation systems.
  • Dry rot, termites, fungus, molds, and bacteria.
  • Moisture-related damage to foundations, floors, walls, windows, and roofs.
  • Pet messes.
  • Insurance claims related to the above.

If you’re seeing any of these in a building you own, rent, or are planning to buy or sell, then you may have some concerns.

I’m going to assume you don’t want to go to court, and that you’d like to resolve these issues as quickly and efficiently as possible, at a reasonable cost … and you’d have more peace of mind if you knew the solution would last.

It’s my job to help make that possible.

I’ve been in the construction industry continuously for the past 45 years. I’ve done it all: hands-on building, managing projects, budgeting, remodeling, remediation, and consulting for every type of project including single-family homes, subdivisions, hotels, motels, parking structures, subway tunnels, and office buildings. I’ve worked with property owners and tenants, and a variety of professionals: attorneys, architects, engineers, subcontractors, real estate professionals, remediation experts, insurance professionals, and insurance adjusters.

I worked on one of the biggest construction defect cases in history: the Los Angeles Metropolitan Transportation Authority subway tunnel case (improper construction led to settlement around the tunnels, which caused damage to the buildings above).

As an expert consultant, I surveyed and documented more than a billion dollars in damage. I then testified in court, and my side got a fair settlement (to the tune of more than a billion dollars).

I’ve also consulted on homes, commercial buildings, other public transportation projects, and more. I’ve helped property owners put together accurate claims for their insurance companies, which then, in most cases, paid more than they originally said they would to cover repairs.

Click here to read about my experience in more detail, but suffice it to say that I’ve earned my expertise … and I want to use it to help you.

I know what to look for, which questions to ask, and how to develop solutions to the problems you’re facing.

As an experienced consultant, I view your situation with objective clarity, and can help you come to a fair solution, while striving to keep your stress and time and money costs as low as possible. If you want to talk about how we can work together, contact me to schedule a complimentary consultation.

When we work together, you can count on me to:

  • Investigate defects and determine their cause as well as the best method—and cost—for repairing them.
  • Survey and monitor ground subsidence and building settlement.
  • Review economic and construction feasibility issues.
  • Schedule projects for investigation and trial purposes.
  • Evaluate construction methods, including adherence to building safety code.
  • Evaluate real estate disclosure issues.
  • Supervise construction.
  • Communicate and liaise with all professionals involved (attorneys, real estate professionals, contractors, subcontractors, owners, and tenants).
  • Prepare for and participate in mediation, arbitration, or trials.

The bottom line: I’ll determine who, what, when, where, and why … and how to make it right.

You already know time is of the essence. Once problems begin, they can multiply, and repair costs increase. There may be a statute of limitations on construction defects. And even if you didn’t cause a problem, you could be liable for it if you don’t disclose it.

The best approach to construction defects, then, is to take action right away, and to enlist the help of an experienced professional, so you can resolve the issues as quickly and fairly as possible.

It has been a privilege to have Tony on our team for projects since 2013.” – Doug Baillie, President, PuroClean Disaster Response, Prescott Valley, AZ

“As a construction expert, Mr. Eller is thorough, fair, dedicated, and a pleasure to work with. In my own work as a private insurance adjuster, I’ve worked with Mr. Eller multiple times. He documented, evaluated, and estimated claims for building/property damages my clients were submitting to their insurance agencies for coverage.  Thanks to his experience, not only in all aspects of the construction industry but also as a former classroom teacher and coach, he can successfully explain construction issues to those who have less experience than he does. He works well with clients (property owners) and adjusters from insurance companies. I would recommend Mr. Eller for any role involving construction issues and/or construction related insurance issues.”  – John Leros, Public insurance adjuster, Arizona

“Tony is a great guy & highly qualified as well. He always went the extra mile for his clients, produced high quality projects & maintained a high degree of integrity/ethics all-the-while. I regret that our mutually beneficial professional (& personal) relationship didn’t continue long-term as a result of my having moved away from his area of ops. I wouldn’t hesitate to recommend him for any & all projects (residential & commercial) he chooses to be involved in….and I continue to wish him all-the-best…you can’t go wrong with Tony.”  – David McDonald, General Contractor
